    Wanchai - just so you know any will you make now will be automatically made null and void when you divorce so you will need to make a new one after that.

    Both marriage and divorce have this effect on a pre-existing will.

    Sorry for your troubles - had you found this leaflet on the Courts Service website? I believe the staff in the courts are very helpful too.

    Marriage will cancel a will ( unless it has been written in anticipation of such and is referred to in the will )

    Divorce does NOT cancel a will - it will however have the effect of removing the spouse from it as if they had never been included.

    So for example if your will stated all to spouse OR to kids then it would go to kids.

    Worth checking if you have a nomination of benefit form for your pension death benefits at work and completing a new one nominating a family member.

    OH spoke to a lady in our local court offices who helped him fill in the divorce forms. She obviously couldn't advise him on anything: she literally was there to help him understand the questions and know the correct format for the answers. Meant he only had to pay the court fees, so saved him a heck of a lot of money.

    I paid a solicitor £50 after my divorce was final.

    A free interview with a solicitor will basically set out what you can read above. After all, they want to make money out off you. Which they are very adept at!
    If you can come to a written agreement without using solicitors then you will save yourself a lot of money and a lot of grief.

    OK, which is it? :o I'm confused!

    My beneficiaries will be family members, who will be named. My ex will not be named at all. Is that sufficient?

    Re death benefit, I had already nominated a sibling when I first started (before I even met my ex or got married). Do I need to check that they didn't change it after I got married? Because I definitely didn't change it.

    Thanks very much to you as well. I will do a search. I'm glad that you came out of it without too much expense. What was the £50 for, out of curiosity?

    Sorry! We're in Coleraine actually :o But just ring your nearest courthouse and ask if there's anyone who can help.

    Solicitor quoted OH £1500+VAT :eek:
    (plus he was needing copies of birth certs for the girls, and marriage cert. Solicitor was charging about £35 for each. We got all 4 certs we needed for £56 I think it was)

    Doing it himself cost about 1/3 of that!

    you will need a solicitor to help with the wording, but you can make a will that states basically "I am separated from my husband and intending to divorce - this will is to stand whether I die before or after the divorce is complete"
    If the worst was to happen, your full intention is known & he would have a job contesting the will in his favour :)
