im not sure where i stand on bank holidays,so help id appreciate.
im currently off work due to injury and have had surgery.but i have missed out on bank holidays.
i missed easter bank holidays, may day and will miss 27th may bank holiday, obviously i am on sick as i cannot work.
but would these holidays be owed to me upon returning to work?
given that they are statutory holidays, that everyone gets..
thank you.

You used to lose them when on the sick, I'm not sure if that's still the case though as I've not been sick for well over 20 years now.
Whatever though, bank hols are definitely not statutory days off - not this side of la Manche anyway0 -
It depends on how your holiday entitlement works. Everyone is entitled to a minimum of 28 days a year, which includes bank holidays (it used to be 20 days plus 8 bank holidays) if they are taken off. If you were off sick then you have not used up those days I suspect and can still take them at a different time.0

i just dont know about it either as ive never been off sick when theres bank holiday days inbetween.
i didnt mean statutory in the sense.i meant if i was in work i would have had those days off and been paid for them.but because im off sick i havent.those days are not in my entitlement i get 26days paid holiday.and i get all bank holiday days too.
what im asking is am i still entitled to those bank holidays, what ive missed out on.0 -
As mcfisco suggests, it depends what your contract says. Take a look at your contract and let us know what it says about annual leave and public holidays.0

The statutory entitlement was never 20 days plus 8 bank holidays. Only those working 5 or more days a week are entitled to 28 days paid leave.
If your normal annual leave entitlement is the statutory minimum of 5.6 weeks (=28 days for someone working 5 or more days a week), then the bank holidays when you are sick are added back to your entitlement.
If your holiday entitlement is at least 5.6 weeks plus bank holidays, the employer can decide whether you can take the equivalent time off at a later date.0 -
thank you littlevoice.
its basically what i was getting at,im not complaining about it to work im just saying that i should get those days added to my entitlement.when i do return.0 -
If you worked for us, you'd get those leave days added back to your entitlement on your return, BUT as others have said, your employer gives more leave than the statutory minimum, so they don't have to. (We also give more than stat. min., but we'd give those days back into entitlement.)Signature removed for peace of mind0
