i've got a bad feeling....

Hi all,

My boyfriend and I are due to be moving into a rental property this weekend. We have signed the tenancy agreement and paid the deposit.

We went back to the flat last week to have one last viewing and to take measurements for furniture etc and noticed that one of the bedroom windows is cracked on the inside (the blind was pulled down when we viewed originally - no we know why!) and the enamel of the bath is cracked and peeling off making it unusable.

We emailed the agency with photos of this, and have just heard back the following:

1 - Window - The internal unit is cracked , the landlords lived there for 18 months and it is not draughty or unsafe , the landlord has no plans to replace it at the moment.
2 - Bath - The landlord is not willing to re surface the bath but have no problems with you having it done at your own cost.
(yeah, i bet they don't!)

Just wondering what you think of this? I am annoyed we didn't spot the window or the bath the first time we went to view, so I am aware we are partly to blame for bringing this up late, however I am surprised they are happy to rent the flat at top whack to us, with these issues.

Any thoughts / suggestions welcome!

    Stable door, horse and bolted are words that spring to mind.

    Since you've agreed to the tenancy (and what you have mentioned is not, in my opinion, enough to frustrate the contract) I am not sure you have any options other than to grin and bear it.

    It's a rental property, fixtures and fittings are never pristine.

    Just make sure it's all recorded in the starting inventory so they don't try and take it off your deposit.

    Someone more knowledgable will be along shortly but I THINK at the moment all you have done is created a contract, not a tenancy (i think you have to actually take occupation for this to happen), you might have more room for negociation at this point.

    Can anyone advise?
