Okay, I have been having the saga over my car for ages now, all I ever wanted was reduced payments, but BCT have meen most unhelpful and I know that I will be handing the car back any day, which will make me sad but there it is. Today tho, I got this in a letter;
"We sent you a default notice recently, and you have not made suitable arrangements to clear your arrears.
This means that you are in breach of the agreementand we have now Terminatedthat agreement with immediate effect AND YOU ARE NO LONGER IN POSSESSION OF THESE GOODS WITHOUT OUR CONSENT"
Blah blah blah..........
Is it me, or have they written this in such a way that says I am in possession of the goods with their consent? If so, could I use this to buy me a bit more time?
Any advice appreciated, thx!!

Hi Danielleindebt, thanks for bumping! I have paid over a third so they will have to take me to court to get it back, and all I've ever asked for is reduced payments!! But my question is, if they'd have said....
"AND YOU ARE NO LONGER IN POSSESSION OF THESE GOODS WITH OUR CONSENT" that would have meant that I do NOT have their permission to keep the car, but what they have said is...
"AND YOU ARE NO LONGER IN POSSESSION OF THESE GOODS WITHOUT OUR CONSENT"
which is saying that I have their consent to have the car.
So does anyone think this letter would stand up in court??

I read it that you were previously in possession of their goods without consent....but no longer.....as you say, don't know how it would stand up in law, but they have tripped themselves up trying to be clever.Official DFW Nerd Club - Member no: 203.0
