INTERIM CHARGING ORDER -HELP I Cant Cope

I've received a letter & court papers stating the RBS have applid for an interim charging order.
I owe them money on a debt of £26k which I've got an agreement to pay £351 per month by standing order.
The first payment should have been in March to go out the day after my wages go in but my new bank hadnt actioned the standing order as I had asked.
I got a letter in april from the RBS saying the payment had been missed so I paid it over the counter at one of their branches then the usual April payment went out on the standing order (2 payments in 1 month). Now I have received another court order saying they have gone for an interim charging order.
I have no idea what to do. To be honest I'm at my wit's end. I've agreed a payment plan & I'm paying it but they are still comming after me.
What will a charging order mean? will I lose my house? How can they do this if I'm making the payments?

Hi there...
Same situation here... but with Natwest... can't offer much advice really... we are making regular payments too and they still went for the charging order... it got knocked back by the judge saying that they needed to give us more time to sort things out (I had just returned to work after maternity) and we now have new court date for July!!!
Just wanted to say... I know its horrid, but there are some key things we were told...
Make sure you go to court...
Take all paperwork, showing payments etc.
and if the court does go in there favour, then ask for a restriction on it which means they can't go for forcing a sale of the property.
Sorry couldn't be much more help... but I am sure someone will come along who knows more stuff...
PM me if you want any further details :0)

so I'm not alone!
I've got difficult circumstances as well. My husband has basically had a breakdown after his dad died. he gave up work a couple of months agobecause he just couldnt cope with anything. He's looking for anothe job now which should help.
I'm just so sick of this. RBS are a bunch of B******s. There is no need for any of it because I'm paying them what they have asked for.
I could understand if I wasnt but I am0 -
Well I do think they are being unreasonable seing as you are paying them a good payment each month... Natwest got funny because I had to lower the payments while on maternity leave... but before that, they were going along with the payment plan...
I know its scary.. believe me... the thought of court again sends shivers down my spine, but I am lucky enough to have a dp who keeps me smiling... and says all the right things... bless him.
All I can say, is stay positive and hope that if you have to go to court then the judge is fair... I promised myself I wouldn't blub in court.... but I did...oops... my dp had to take over talking because I couldn't get any words out... big lush I know.
Anyways... I could type forever... so I'll shut up now
Hope you are ok...

I have got a charging order on my property.
It simply means that if / when you sell, the debt the charge relates to will be settled from the proceeds, along with your mortgage.
They cant force you to sell, apart from very extreme circumstancesIs it better to aim for the stars and hit a tree or aim for a tree and land in its branches :think:Loves being a Wonderbra friend :kisses3:

If the problems are due to illness, try and get something in writing from your OH's GP. Ie if it does go to court then this is evidence of part of the reason why things went awry, and that now he is looking for work things should improve, along with the other information already mentioned
chevI want a job that is less than an hour driving away from my house! Are you listening universe?
