Should I not bother?

Due to a recent residency change my ex is still claiming child benefit and child tax credits (because he is refusing to sign the form stating he no longer cares for the children).. which means in about 2-3 months I may actually start receiving both.

He has the children 2 nights every fortnight (52 nights a year).

He works 1-2 nights a week cash in hand so untraceable (or he at least did).

He is claiming benefits.

CSA calculator states 52-102 nights year he doesnt have to pay anything because he is on benefits. Yet if it were 51 nights a year he would pay £5 a week (which right now.. every little helps)!!.

But part of me is thinking... I will be wasting CSA's time and resources applying just to be told he doesnt have to pay anything.

But yet he is able to continue being paid £140 or so a week for children he is no longer caring for... and theres plop all I can do about it until they ask me for evidence (which they have refused currently and have told me I have to wait weeks until they request it).

    So your children used to live with your ex and now they live with you but he still gets CB and CTC paid to him?

    Are you currently paying him any child maintenance through the CSA?

    Once you get the CB transferred over to you are you still going to propose to cut your ex's visits by one a day year for a fiver a month?

    Are you in good terms with him, is it really worth the hassle for £5 a month when you just have to wait a few months to get CB and CTC?

    I just skimmed through your post on the benefits board and oh my lord what hassle you've been through. TBH I don't see your ex agreeing to cut his visits by one day so if he loses his job you wont be entitled to any CS.

    However, it may be worth starting a case with the CSA if you feel your ex can contribute to their financial upbringing right now. The only problem is that CS is inherently linked to CB by the CSA so they may not allow you to receive CS until you are the parent receiving CB.

    How long do you think it will take for you to get CB transferred over to you?
