I would be very grateful for some help if any one can????

I had a credit card with MBNA that I couldn't afford to keep up the payments on, I set up a plan with them to pay them £23 per month and they stopped all interest and charges. This was fine and I was managing to keep the payments going.

On 13th March I was advised by MBNA that the ownership of my debt would be transferring to Ackiv Kapital. I have received a lot of letters and up to 15 calls per day from them since, but I am very wary of how to deal with them as I have read some real horror stories on here and others sites.I haven't answered one call or written to them at all since this started.

I received a letter today saying if I fail to contact them they will "review my account and look into my financial status. This will include aspects such as your housing situation and your employment status. Depending on our findings we may proceed with litigation." Is this just a scare tactic as I'm not sure if they can find out any info on me legally. Can they do this or is it is covered by the Data Protection Act or some similar law? I don't want them digging around and highlighting this to my employers or my landlady (I rent privately). Can they begin litigation or take me to court??

I don't mind paying them what I was paying before, but am very cautious about answering the phone or writing as I don't want to say something I shouldn't? I also dont want to give them any of my bank details, will they accept a standing order as this is me sending payment to them rather than them taking it?

The last payment I made to MBNA was 28th January 2013.

I think I have covered everything that would help.

I would be grateful for any help or advice that anyone can give.

    i think MBNA are doing this with a lot of customers who keep missing payments paying less than min option...best advice is to speak to them and agree to a payment plan my friends with them and she has had no issues as far as im aware they took hers over as she had lost her job etc... they set payment up to what she had originally been paying and froze card interest etc..

    Don't worry they cannot find out much information on you at all. They can look at your credit file but very little else.

    Best way to deal with them is to send a letter stating your situation hasn't changed and you can currently only afford to pay £23 per month. Ask them for their bank details so that you can set up a standing order for this amount.

    Then I would also add on the letter the text from the telephone harrasment letter requesting that all communication is in writing - see template - Telephone Harassment Template Letter
