Could anyone give me some advice please....
We've finally received a breakdown of how the OR has come to the final figure for the IPA.
Some of the things we agree with and others not. Could someone please give us their opinion. We are a family of 3.
The OR has made an allowance for £66 for clothing. Because I have a senior role in my current employment, it is essential I wear suits, tie etc. I represent the company at many events both in this country and overseas so I can't exactly wear jeans and a t shirt. What sort of figure should I be asking for the OR to consider? As a family we currently spend more than 66 on clothes.
Likewise, I have to look smart for my job, as do the rest of my family. We have been allowed £20
Holidays are £30. I understood we would be allowed at least 50 for a family of 3.
Am I right in thinking we can claim for dry cleaning?
Can we claim for AA/RAC?
Are tree any other things that we might claim for that are different to the usual expenses?
How are Christmas and birthdays dealt with? Any allowance for these??
My wife has a credit card bill which wasn't included in the original bankruptcy as they were in her name. Can repayments of these be offset against disposable income?
The bankruptcy is in my name only.
Any advice would be really appreciated.

    I'm not sure about clothes allowances but to me (an economist) £66 seems reasonable to me for 3 people even if you need to be smart for work.
    Holidays, I know people have been allowed £50 for a family of 3 before so that is not unreasonable.
    Yes if your work involves suits, then yes to dry cleaning.
    AA/RAC at basic roadside level the OR told me, I pay £34 per year for mine so that's not a lot.
    No allowance can be made from your SOA for your wife's credit card, that is her responsibility. Does she work?

    You can definitely discuss with the OR your needs, it is an agreement so you can say yes or no, state why you feel your need more for things. Ultimately the OR will either accept your amounts you say you need or decide to refer it to court for an IPO for a Judge to decide.

    You can discuss with the OR yes, but from what you say, and the figures you give, the amounts sound reasonable to me. How often do you need to buy new suits? Surely 2 or 3 would be enough for a year... If it's essential you wear new clothes all the time for your job, then ask your employer to provide an allowance.

    Christmas and birthday should be under miscellaneous.

    You would have to ask about your wife's credit card. Did you mention this? What did they say?

    Re; holidays. With most people who go bankrupt, the last thing on their mind is holidays: they're just glad to be rid of the debt. So I think if you keep on about too many luxuries, the OR will just be annoyed. Unfortunately, one of the pitfalls of bankruptcy is you can't have luxuries. It doesn't work like that I'm afraid. And you need to economise and make things last... So complaining that you need more money for clothes probably isn't going to go down well.

    All that has happened is that your budget has been trimmed down in order to pay the IS case management fee.

    And you're quite right that you can claim for a reasonable budget for clothes and holidays, but the amount they have sounds perfectly reasonable to me.

    I've said no to every IPA I have dealt with since the regime change in December 2010. In every case I have either achieved no IPA or a reduced IPA.

    I have helped many on here via PM to reduce or negate completely their IPA, and currently have 7 on the go.

    I certainly agree that the OR s are getting very ridged or keen, but that is merely to pay for their own case management fees since they became insolvent in 2010.

    The new regime does not reflect the law,- they know it and I (and many adviser colleagues) know it.

    I ignore their current policy.

    If you want to pm me your e-mail address I can send you the spread sheet the OR uses for calculating it, my OR sent it to me at my request in January when mine was reassess. It shows all current allowances.
