Council tax bailiff coming back Thursday for money i cant afford!

    If the bailiff doesn't get anywhere then they will probably pass the debt back to the council. When this happens you will be in a better position to arrange a payment plan with the council.

    Firstly, thank you all so very much for replying.

    I have phoned the council, to find out how much the original debt was, and whilst on the phone I asked if it Would be possible to set up a payment plan and she said no because it's now up to the bailiff, and that it was out of their hands, is this not right then?

    They cannot come with a police officer as this is a civil matter. They cannot comne in the house unless you invite them in.

    You would be completely stupid to let them in. Keep windows and doors locked and make sure that you do not answer the door (if s/he turns up which may be quite unlikely).

    Is this equita bailiffs? They are owned by Capita who run the back-room Council Tax collection for a lot of councils. Capita staff seem to always tell people that they have to deal with the baillifs. You do not have to deal with the bailiffs.

    There is an account code; use that to pay the Council the sum you owe on-line.

    You will have to pay two visit fees which is £42.50 to the bailiffs. Send them a cheque.

    you will not go to jail for this jail is only for wilful refusal or culpable neglect
    THIS is legislation and neither your council or Equita can change that

    If (and only if) the court is of the opinion that his failure is due to his wilful refusal or culpable neglect it may if it thinks fit—
    (a)issue a warrant of commitment against the debtor, or

    (b)fix a term of imprisonment and postpone the issue of the warrant until such time and on such conditions (if any) as the court thinks just.


    if he original debt was for £520 and the bailiff now wants £840 then their would have to be a levy on your goods as most fees are set by legislation
    have you been left a notice of seizure/distress ?
    do you own a vehicle ?

    please stop dealing with this over the phone unless you can record the calls (can you record your calls?)

    can you please check and see if the bailiff is on the bailiffs register certificated to Rossendales

    The bailiff has posted 2 letters, the first says notice of bailiff attendance (she didn't knock, just posted this) and its dates 6th march.

    The second letter was again posted on 8th May, and reads bailiff removal.

    These are the only times I am aware they have been to my home. So if they only charge £42.50 does anyone know why my debt has gone up £300?
    We have no car, had to sell it because we couldn't afford to keep up with it.

    because they are trying to milk you.

    start paying the council what you can afford. if they try and refuse payment get them to put that in writing. just make sure its going against the right years charge.

    re the bailliffs write to them and request a breakdown of their charges. have you factored the court costs ect into it.

    do you have proof of your illness (doctors letters ect)

    can you tell me what amounts are written on the letters left as in
    outstanding balance £520 amount of fees charged for this visit "24.50

    or is the total balance simply written as £xxxx

    did you confirm she is certificated to rossendales
