Time to sort things out...

Hi All

I have been in a large amount of debt since 2005 (near £30,000)
I contacted (what was) cccs back then and started a dmp. As a couple of years went on circumstances changed and after more advice they suggested I declare myself bankrupt.
I stopped dmp payments(I have now assests) and since then only received the odd letter from debtors.
I looked into bankruptcy but could never raise the money to go ahead and do it....and now I'm here!
I have recently divorced(no debt is attache to ex) and am starting a new life with my new partner.
So...took a big step today to try and get things sorted, I called 'Stepchange' and the very lovely lady checked through my credit report to see it was only showing one ccj of £15,000 and nothing else.
I'm due another call from them next week but I'm confused as to where the other debt has gone, it was a few credit cards and a couple of loans?
The CCJ was in court July 2008.
Am I right in thinking a CCJ remains on your account for a certain amount of time or will it just sit there forever?
If anyone can help or shed some light on things I would really appreciated it...

    Entries stay on your credit file for 6 years after they are defaulted or settled. CCJs likewise stay on for 6 years after the date of judgement.

    CCJs never actually expire but can only be enforced by order of the court if it is more than 6 years after judgement.

    If you stopped making payment to your non-CCJ creditors before April 2007, these debts will now be statute barred (6 years, England/Wales) and you have a defence to any court action on these.

    Am I right in thinking that my debts have been taken off my file as its past the 6 years, however the ccj is still there as it was 2008 so sometime next year that will be removed? Or do you mean I will need to ask for the ccj to be removed?

    The entry on your credit file will drop off after six years, but the CCJ itself will still exist.

    It will drop off your file in 2014. I was just trying to say that it doesn't 'cease to exist'. But if it hasn't been enforced by then it would require a separate court order, which may or may not be granted.

    In most cases if a ccj has had no action on it in 5 years the creditor isn't going to attempt anything in the 6th.

    And once it drops off your file, only the original creditor will know about it.
  • So come 2014 when it will come off my file is there anything I need to do to be able to move forward with getting a mortgage or am I still in a poor position credit wise?

    Make sure you're on the electoral roll; have a credit card that you pay off in full each month; don't go near whoever got a ccj against you!
  • Right ok, thank you for the advice, have already got a next account (only £100 credit limit with very little spend on)which Im up to date with and going to keep on top of to look good hopefully!

    No but as far as I know some lenders ask questions like 'have you ever had a default/CCJ recorded against you?' and things like that.
