Low pay - illegal ?

I work as an ICT technician at a local school for 10 hours per week - for which I am paid less than £6 per hour - GROSS !
The schools argument is that I am only employed (permanent contract) to work school term time (39 weeks per year) - and if they average my pay over the year - it works out at £7.09 per hour ...
Can they do this ?
Or am I being taken advantage of ?

    Minimum wage is £6.31 so no, your not being stiffed.

    If your hourly rate on the actual hours you work in the year is £7.09 then its perfectly legal. Just because you are paid over 12 months it doesn't mena your hourly rate is reduced.

    I asume that's what you mean because your argument seems to be mixed up the wrong way around.

    It sounds as though your employer is paying you for work you've done, but spreading out over 52 weeks instead of 39 so you don't end up with weeks where you have no money coming in due to not having worked. If this is the case then I can't see any reason why it would be illegal.

    As long as your receiving £6.19 for each hour worked then you're not being underpaid.

    Yes - they are paying you over minimum wage - this is usual for 'term time only' contracts.
