Leaving my job under the 3 month probation period

Hello all,

This is my first post so I am sorry if this has come up else where or if I have not put it in the right bit of the forum. I just wanted some advice and I have heard that this is a great site for it.

I am working at the moment for a sales company where I cold call people and sell TV insurance to them. (I am very sorry if I have ever called you!!) I have been offered another job though and I am meant to start there on Monday. I have to wait for a few details to come through from HR about it but I have been told that the start date is on the 20th May. The chances are that I will be working there come next Monday.

The thing that I want advice on though is I have done 11 days work for this company and I get around £60 a day for what I am doing. I am due to be paid this on the 31st and I do need this money to pay rent to my mum and get food and things like that. I am not sure if I should tell my manager now that I am going to be moving to another company because say if something went wrong then I would be out of a job. Also I don't want to leave it until the end of the week and then just drop it on him that I will be leaving and I won't be working anymore in case they say to me that I wont get a weeks wages or even worse won't get paid.

I am on a 3 month probation and I am wondering do they have any legal rights to say to me I won't get paid if I just said to him that I am leaving and I am starting at another company on Monday. With a probation period I know that the company can get rid of my at any time with out a reason. I am wondering if I can do the same?

Sorry its quite a bit post but any help then it would really help me out.

    No, you are to be paid for the days you have worked, regardless of the reason for your departure. You can not turn up tomorrow and subsequently sacked, you should still be aid all monies owed.

    What is your notice period? 1 week? You should give it both legally and responsibly, but reality is a different matter. Are you relying on a reference? If so be as nice to your current employer as possible.

    If you aren't relying on reference you could just not turn up Monday, and start your new job. Of course you will probably be sacked from your old job.

    I am not sure what my notice period is. I might ask someone who has worked there a while.

    I haven't been given a contract yet all that I have signed is the office rules which just has all the information about what to do when on the phone, how to leave your desk and things like that.

    There is nothing in there about a notice or anything. I am just going to give my manager as much notice as possible. As soon as I am given the yes to work for this other company I will tell him. He is a nice man and I don't think he wouldn't give me a reference. I am not relying on one anyway.

    If you haven't been given/signed a contract the default legal position would be 1 week notice.
