Can Fitness First pass on my financial info?..They have

In short.
1. My partner joined fitness first Chelmsford, its ok for a few months, facilities are a bit below par eg: of the 3 working showers there not much more than a dribble.
-He choose FF as I can use their other gyms as I travel alot.
2. November 2012 its announced FF Chelmsford is to be sold/closed
..make sense what it was so tatty looking.
He spoke to the membership manager and asked to cancel as I needed the option to use others. 'Lee' said this was fine.
3 December an independent gym called 364 took over.
4. I find today that I have paid £125 in gym fees this year to 364
Firstly, does anyone know if this is legal?? For fitness first to sell/pass on my DD without advice?
Harlands - the DD company claim I would have had a letter from each of the 3 parties, themselves FF and 364. Did I 'eck.
I have emailed 364 asking for a reply, hopefully its a yes.
If its a no, where do I stand?
