mortgage lenders and estate disputes

we have been told our conveyancer that our mortgage lender won't give us the funds if there is an ongoing service charge dispute on the estate we're buying on?? basically there is a dispute between the whole estate and a maintenance company. I have looked through our mortgage offer paperwork and can't see anything that states this is the case? And sellers solicitor can't understand what the problem is as sellers have paid the service charge until the end of 2013.
Any advice? Starting to worry as if it is the case then we are basically trying to pursue a house we can't buy?? We are in week 11 since our offer was excepted.

    Have you spoken to your conveyancer to ascertain precisely what the issue is?

    we are having a bit of a problem with our conveyancer. He provides really poor customer service and had to make a complaint about him. He never returns our calls apart from Friday when he phoned us for the first time since the middle of march!! He basically just told us what I said above. But not sure if its just him trying to make excuses for how slow he's being, as sellers solicitor can't see what the problem is, and houses are being bought and sold on the estate all the time.

    Only your conveyancer knows what is going on but generally there could be an indemnity policy put in place or funds witheld from the vendor to cover any shortfall in rent.

    Is it a conveyancer of your choosing or a lender appointed one?

    the sellers solicitor has said they will hold some money in case there is any future problem. Our conveyancer was recommended to us by our mortgage broker (I know there are payments made for recommendations!) but we were FTB and decided to go with them. Our mortgage broker has been excellent to be fair and they were the ones who helped us raise the complaint and have been very supportive.

    I think our conveyancer is used by our lender quite a lot though.

    They represent their own clients interest not yours.
