Issues with Santander loan

Hi:j I need help me with the following issue
I took out a loan with Santander who failed to set up the direct debit. Twice I notified them and twice they told me all was set up!
After 8 months nothing was collected and they then wrote to me demanding the full repayment.
After a phone all and letter they said unless they had the arrears paid they would refer my account to a debt collection
In a letter from them they then apologised and said they had a system issue.
My account was forwarded too moor croft with Santander stating the loan has nothing to do with them
Moor croft have doubled the original payment from a £110 a month to £220 a month.
Every 6 months I get a statement from Santander so they have not sold the debt just pocketing from the extra interest I am paying!

Santander failed too set up the dd but I am being penalised.
I have just paid the £10 under the data protection act and awaiting my details before I go to the ombudsman.
Day think I have a case?

    You notified them twice in 8 months?

    When you noticed the DD wasn't setup why didn't you pay via other means?

    Im not sure what you are hoping the SAR will show either :/

    So, I'll take it, those eight monthly payments, Santander failed to collect are still sitting in your bank account.

    You didn't spent that dosh on other things........did you?

    Also, before you go to the FOS you need to have exhausted their (Santanders) complaints procedure, giving them 8 weeks to respond to your written complaint. Have you done this?

    What stage are you at with Santander's complaint process?

    So in 8 months you contacted them twice to tell them that there was a problem, but made no attempt to clear the arrears?

    Don't you think that you are partially at fault here?

    hmmm, not sure we have the full story here....BUT, I have had experience of Santander not taking payments when DD's ARE set up, BUT I of course contacted them to pay........

    Don't you know that it is illegal to do the sensible thing in these circumstances.
    You are supposed to spend the money and then moan about it when the letter to correct the mistake, arrives on your door step.
    I can afford anything that I want.
    Just so long as I don't want much.

    It isn't clear if the op has ever paid a penny toward this loan.
