I took out a payday loan about 18 months ago, I was desperate as I had just had to pay out for a new fridge. I then lost my job just after christmas and my lloyds bank started getting stressy with me to pay fines etc, so when cash genie tried to take the money back it failed, so they then took money using my card out of the lloyds account which wasn't there, but lloyds gave it to them making me more in debt with lloyds.

I didn't contact lloyds again as I was depressed.

For the past few months I have been hassled and harrased by carter forbes about cash genie. they have abused me over the phone, sent hundreds of spam texts, I have had to move house (not told them) change phone number, email addresss and more.

this morning I got this

Dear Client

As you are aware, Cash Genie and ourselves have made several attempts to contact you and help you regarding your outstanding Cash Genie account.

We have tried to call you, text you, email you and have written to you on numerous occasions. Unfortunately, despite our attempts to contact you no contact has been made by you to show your intent to repay the outstanding balance above.

We now want to give you one further option to repay this debt – Legal Proceedings/Court Action. (Resulting in possible Attachment of earnings A.O.E or County Court Judgement CCJ)

If you feel that we cannot assist you further with the debt, please confirm the following information and once confirmed our legal department will write to you to confirm the next steps in the process –

    at one point when they rang they called me a lazy layabout.

    simple don't help them don't give them the info they are asking for. if the calls are effecting you write a letter telling them that you will only deal with the matter in writing. if your on benefits offer them a £1 a month. and let them do the worst. which will either be nothing or a ccj but the judge will only order you to pay what you can afford.

    a few years back i had issues with one debt collector they loved to phone however refusing to answer their security questions really bogs them off. what you must do is remain in charge they will try to make you feel small dont let them.

    If you moved house, how did they track you down ?. I'd guess you registered to vote & forgot to tick the box to put you on the 'non-searchable' list.

    You could try sending the letters back unopened with 'No longer at this address & no forwarding address left' written on them. However, at the end of the day, it is worth letting them take you to Court as you can submit a SoA & likely get away with paying their debt off at £1 a month.

    If you you do need to deal with them, do it in writing only, for reasons you have experienced.

    Report them to the OFT for harassment. This is how they should treat you:

    Then keep note of everything and present to the judge should they decide to take you to court. They won't look good.
