Hi I live in Spain but have serious debts in the Uk have managed to avoid them for a couple of years but feel bankruptcy is the way to go I seem to be getting conflicting advice myesta tell me I have go bankrupt in spain but earlier in the year I was told by them that I could do it in Uk as long as it was within 3years of my departure....anyone help???

    I was also told by Myvesta that within 3 years you can petition in the UK. I would definately do this if I were you!

    they now say I can't do that!
    If you reside outside the UK and have debts based in the UK, it is possible to file for bankruptcy whilst outside the UK. There are many conditions for this: if you are residing in any of the EU countries and have been for over 6 months, you must file bankruptcy in that country according to that country’s bankruptcy laws and procedures. If you are residing outside any EU country and have not been outside the UK for over 3 years, you can file for bankruptcy in the UK, however you will need a representative to do this for you as it is filed in the High Court in London. Our Foreign Bankruptcy Assistance Programme can help with this......

    I asked MYVESTA if the rules had changed and they said we checked this out with the Insolvency Service last month , and that was there reply.!!!!!!!!!!!

    Do I crack on daft and say I was living at mothers?

    Hi Inspain...I am having similar problems...when I contacted Myvesta they too said I couldn´t petition in the UK if I was living in Spain. They actually suggested I don´t give me address and do a runner. Not very constructive. I´m trying to get a definitive answer if I can go to the High Court and petition...some people say this is possible and can be done in 2 weeks...

    Hey all

    I just tried Myvesta again...this time they said that if you live outside the EU and it´s within 3 years of being a resident in the UK you can file in the UK but more than 3 months you have to go through the spanish courts. They said they got their info from the bankruptcy service.

    i´ve sent a mail to the Insolvency Government website asking the same question. Last time I did that they didn´t reply...but if they do this time I´ll post it.

    Have to say I feel like I want a legal opinion rather than one from these websites. I feel slightly nervous that a government agency isn´t going to be on my side but maybe that´s just the cynic in me!

    thanks all. i´m started to feel exhausted by it all again. Heavens knows what to do if I have to go through the spanish courts.
