holiday pay from previous year

My husband is currently off sick following an accident in November 2012. He has 2 days unclaimed holiday for the year 2012. Can he ask for payment for the days?

he can ask and they could pay it but it should roll over into this year and be used when he is back from the sick. If he doesn't return it should be paid with the holiday he is gaining at the moment.

If he is struggling on ssp he can ask them to pay him any holiday pay he has accrued while he is off instead of ssp

My OH's employer had a 'use it or lose it' policy.

If you didn't use all your holiday days by the end of the year, you lost them, they didn't get carried over.

You can't do this if you are off sick when the end of year ticks over
