    You'd have been on emergency tax regardless. An employer has to put you on emergency tax until they get your tax code from their tax office, even if it's the same one as your previous employer. It can take up to 6 weeks.

    The only thing a P45 serves to do now is act as a confirmation of the total income for that tax year from your previous employer.

    when you get your p60 - if you think you have paid too much tax, you can claim a refund

    Maybe things have changed since I last did payroll, but my memory of the instructions is to use the old code from the P45, send a copy to HMRC and await their instructions - if it's right, you hear nowt, and if it's wrong they send a new code through.

    If no P45, use a P46. If it's the only or main job, use the 'normal' tax code but on a Week 1 / Month 1 basis.

    I don't have access to the employer's pack any more or I'd double check that ...

    Correct, however if the P45 is over 6 weeks old you need a P46 instead.

    So what should I be taking into the office then, the p45 or the p46 ( to my current employer?) or both?

    I will have been emergency taxed tho - however do I have to wait for the p46 for my CURRENT tax year to claim it back ( april 08) or the one from April 07? :confused:

    I'm not sure, because by the sound of it your P45 is wrong as they should have paid you some notice. But as you may have a long wait to sort that out, and I don't know if they will re-issue a P45 anyway, you may do better giving in the P46. You could phone your local tax office and ask for advice, they are usually very helpful, and if YOU know what your previous employer SHOULD be doing, it puts you in a stronger position.

    And no, you shouldn't have to wait for the end of the tax year for any tax you've overpaid this year. When you get a tax code sent to your employer, you will probably pay less tax for a month or even get a refund, and then it will settle down to your 'normal' amount.

    Because unless you're on a Week 1 / Month 1 code, your employer should work out every month how much tax you're due to pay in the light of how much you've already paid, and how much gross salary you've had.

    REgarding the emergency tax, your employer will re-imburse you any overpayment you've made in tax as soon as your tax code has been received.

    If your P45 is wrong dont hand it in, fill in P46 instead and you will end up with 522L wk1/m1 assuming you are on a standard tax code.

    When you have the P45 with the correct figures on, hand that in.

    The tax office will send your new emloyer a 'Notice of Coding' to correct your tax code and if you have had overpaid for any reason this change will give you a rebate via your wages.

    If you do not hand in a P46 or a P45 you will pay Basic Rate tax which means you will pay tax on all of the money you earn without your allowence being considered.
