When does Child Maintenance stop?

I was led to believe maintenance was due, if a 18/19yr was in qualifying education, until the Monday following their 19th birthday, then it stops.
Is this not the case?
I believe it is, in the posters question they have an 18 year old that is going into non-qualifying education so will stop before they are 190 -
My child left school and is allegedly at College. I have to pay maintenance while he is in education but my ex wife and son refuse to tell me which college he is attending. I think he has left school and don't know what to do. Any advice out there?0

my friend has 1 16 year old who finishes school this year and will b doing a levels, now i understand payments still have 2 b made but can the money now b givin 2 the child and not the mother. as she is always bleedin him dry and even tho he is on a very low wage has been givin her £30 a week plus extras when needed0

jf4sb, the money cannot be given to the child - if it is, it will not be counted as CM. My ex tried to convice the CSA that he had been giving money to our children instead of me - he hadn't, but the CSA told me that it was immaterial anyway. Our eldest was studying for her A levels at the time.0

thx for this advice, ive been reading this site and thier is alot of conflicting information 2 wot the rights r, he just wants all the fact within the law so he cant get any come backs. it just seems the csa dont really know wot they r doing cause they help some people 2 thier advantage and some who suffer big time. i feel sorry 4 men who have other children that they also need 2 provide 4 and have 2 leave themselfs without any money everyweek0

My son is 18 in Sept and off to uni in sept too. I have a court in place that dates back to 1990's which orders maintenance to be paid until he reaches 17 or leaves full time education which ever is the latter.
My ex states that his legal obligation ends when he reaches 18 & when he finshes A levels.
I offered him the opportuntiy to pay less directly to my son from sept but we cannot agree on a figure, he wants to pay less than half from the original court order in place currently,which i have refused.
He states he cannot afford to pay more than he has offered and has gone without so much over the years to keep to his maintenance order. We have always battled over finance's where the children are concerned, he thinks he's financing my lifestyle and forgets how much it costs to bring children up. He says my son should stand on his own two feet now and get a job to finance his studies and should learn to live life the hard way like he did.
Where do i stand, do i have to take it back to court as soon as he stops paying and do i have a case?0 -

You can't do anything as he has stuck to the agreement which covers the situation until your son starts Uni. Now your son is 18 your son must stand on his own 2 feet. If your son is unhappy HE can attempt to sue his father for maintenance as you have NO say in the matter.
I pay my son directly (more than the CM agreement) since he went to Uni on the condition he does not tell his mother how much - she assumes therefore I am paying him absolutely nothing and it really irks her. She constantly contacts me and I just love telling her to **** off.0 -

Does this mean I have to pay my ex or can I pay money direct to my son then allow him to pay his mum when he is back from uni from the money I give him.

It depends on how the court order is worded. Tertiary means third level so assume this is university education and the order would be between you and your ex so more than likely, legally you need to pay her. This was a real stumbling block between my partner and his ex, she wanted the word tertiary included in the order but partner refused. Took months to come to agreement but worth it as the judge stated maintenance needs to be decided by CSA if they couldn't agree, so that's what happened.
Unless you can come to some other arrangement with the mother I think legally you have to pay direct to her while your son is at university.0 -

You could always open a CSA case to pay maintenance - that would take precedence over the court order, and would mean your liability to pay would end when your son went to University as the Child Benefit payments would cease in September. Beyond that point you could support him directly, if that is what you would prefer.0
