MIL Collections... Again

Hi all,

My girlfriends is having problems with MIL Collections. Last year between April and June we had a few letters about a debt she does not acknowledge to be her own.

So we sent a letter to MIL asking for a copy of the credit agreement from the creditor, we then received a letter from the creditor ( SSe
E electricity) explaining no signed contract is required between themselves and customer.

This was received on the 25 July 2012,we then waited for further contact by MIL Collections before taking further action.

We have received nothing from them until now, letter dated 01 May 2013

Further more there is another incomplete name on the letters from MIL collections???

We are looking on advice on how to proceed now that they have decided to contact.

Does the incomplete name on their letters suggest they do not actually have a clear picture of who owes this debt?

Any help would be much appreciated to get shot of these chancers!

  • Shouldn't you be sending a "Prove It" letter instead?

I think we were a little confused last year and still do not quite understand the process. Is this something we should send now? Or have we now done it in the wrong order?
  • You can still send it.

I will send a prove it letter, however is there anyway I can draw attention to the unknown party the debt is also addressed to?

As I feel this shows that MIL Collections cannot pin the debt on an individual?

Not so much done it in the wrong order as sent the wrong signal. By asking for the credit agreement, it looks like you are trying to get out of a debt which you are shall we say, not denying.

The prove it letter and a firm denial that it is her debt is what is called for.
You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

Thank you ValHaller we will take your advice and get her to write denial letter asking to prove it.

Do you have an opinion on the other party the letter is addressed to, should this be highlighted in the prove it letter?

Is it for electricity bill for a place she used to live at?

A written contract isn't always required, if you consume electricity then that usage creates an assumed contract.

It is but she did not live at the residence over the time the debt Is dated.

I think they have gotten her name along with the other but have managed to track her down and are trying to bully her into paying.
