  • Well I have found the paperwork, and in there is a default notice issued from Mercers in Sept 08, and yet the CRA's show no default. There is also a CCA request, and they sent me a copy of the terms in place at the time I applied, which I complained about, and there is then a legalese letter stating they don't need to send a signed one and lots of legal waffle... so no idea what to do now haha!

    So if they default me now, in reality they should amend it to 2009 when it all first started as that is when it went to 6 months in areas, my credit file just shows more than 3 years worth of 6's and shows as late payment :(
    Yes, unless you came to an arrangement. Even then, the bit in here about being no worse off than someone who made no attempt to pay is basis for complaint if they default you at any point from now on.

    I think it also says that consecutive 6s should not be used to indicate a default.

    Like I say, complain and try to get a default in 2009.

  • Thanks HB, may be worth a complaint letter querying why the default I have from Sept 08 hasn't been registered and why there are still reporting it as late, however that will def wake the sleeping dog so have to have all my ducks in a row to attack first I think haha!
