CSA want old debt paid or it goes to baliffs please help!

    Have you tried emailing your local MP? You can do this online, they are often very good. Get them onto your case, it can only help. This is a totally unreasonable demand. Perhaps you could suggest to the Ex that her benefit fraud can't be put onto you and your family, and that your family will suffer hardship for it.


    On the other hand, the child wont be young forever and you wont be paying her forever.

    Trouble is my husband don't want to rock the boat as she gets shirty with him.
    We even had to watch her and her b'friend claim and work and he got his mortgage paid for 2 years via her claiming.Then they would take all their 3 kids to spain for 2 weeks and we went without hols as we could't afford it.paying £250 a month csa
    It didn't work out with b'friend
    I just have to believe in what goes around comes around~every dog has its day!!

    Sadly, yes you do. You could always report her for Benefit Fraud but then does the same apply to that? What goes around comes around? Do you see what I mean? Or does reporting Benefit Fraud not count in that Karmic analysis since it is illegal?!

    There was a few calls made when she lived with b'friend but nothing came of it.
    All I'm saying is my husband won't tell the csa straight that she is working on the side hairdressing and has been for 10 years

    I also kept saying to husband to tell them she was living with someone but he was worried about the implications of all this on his son
    Don't get me wrong I have had to live with all this for 8 years and its put huge stress on us but I can only do so much as I don't want to put my relationship on the line because of her thats why the calls were anon.

    My partner got into arrears with the CSA (not quite as much as you) and my partner had been been paying a little extra towards this monthly when he received a letter demanding repayment of all outstanding arrears. He called the CSA and explained that he didn't have this kind of money just lying around and so they have agreed to carry on the repayment as he was already doing before the letter. I think the best action is to speak to them.

    sort out the problem with the csa and inform on the ex for fraud

    Sorry to ask you so many questions kelloggs36 but you seem to be in the know about so much , thank-you for all your time and I hope everything goes well for you in the future.

    If they agree to negotiate and accept a lower plan, then it could prevent it going to debt recovery but you need to act fast. There are no guarantees, it depends on who you get and how hard-hearted they are, but if you take the advice given previously you may stand a better chance.

    The legislation issue regards them not being able to force you to repay the debt within the 2 years. As there is none, you have more of an arguing standpoint.

    A liability order is a legal order given by the Court which acknowledges the debt so that other legal action can follow at a later date. They apply to the Courts in respect of the debt which applies at a certain date and if it is granted it just means that it has been legally acknowledged. They can then consider other action, such as charging orders to secure the debt, and County Court judgements which is noted on your partner's financial record which could hamper his chances of getting credit in future, such as a bank account, credit card etc.

    Thanks again ,my husband spoke to a case worker who said this deal with it going to a debt recovery is a new csa policy not the goverment.It seems whoever we speak to won't let us set up a DD monthly.
    The case worker is looking into the fact we had 2 kids that they never took into consideration but said it may be too late and we may need to appeal to get them to do this even though it was them that said they didn't matter.
    As for the monies given to the ex she won't do a letter even though it will come off our bill so unless shes willing to do a letter upfront I told my husband she won't be getting any more.
    As far as her being on the fiddle I hope this opens peoples eyes that sometimes it is the women and not the man ,but the dad gets penalised
    I will be telling on her as I said I have in the past to no avail
