Tribunal CMO..no docs released

Don't know if anyone else has encountered this in their claims, so here goes.

I am at the stage in my case where I requested documents from ex employer. Calendar of where abouts of senior staff, electronic door key log amongst other stuff. As I am basing my case on the senior staff not having adequate time in the office to check /sign off paperwork even though it was prepared. The reason I was dismissed was then they said paper work was not ready.

Where do I stand? I have requested docs that I believe are relevant, yet they say no and refuse to release them.
How will this look on me if it goes all they way to tribunal hearing with no documents?

Also, if an ex gratia offer has been made, what is a nice and polite way to say thanks, but no thanks.
