Bank holiday / Lieu Day question

Hi there,
Can't get my head around this and my colleagues are all saying different!
My rota days off always fall on a Monday. If one of those Mondays is a Bank Holiday I get a day off in Lieu to take another day.
This year I have been asked to work the bank holiday and the payment terms are pay plus a day off in lieu.
So....do I get 2 days off in lieu and the pay (above plus my usual day off in lieu) or just the pay and 1 day off?
We are all saying different in the office here!!
Thanks :j

You are entitled to 5.6 weeks holiday per year, if you are off on a bank holiday (and it is a normal working day for you) then that is 1 less day out of your 5.6 weeks, if you work the bank holiday then you still have your holiday that are owed to you but it's contractual if your company offers extra days.Be Alert..........Britain needs lerts.0

You are getting confused (understandably) over how holidays are calculated.
If you work full time you are entitled to 5.6 weeks statutory annual leave each year (28 working days). This INCLUDES bank holidays.
Some companies phrase this as 20 days annual leave plus bank holidays (on the basis that there are normally 8 bank holidays a year). So the first thing to do is to check your contract (or employee handbook) and see if they allocate holidays this way. If so, that explains why you get a lieu day when your normal day off falls on a bank holiday (this is because you cannot have a rota'd day off and lose an annual leave day at the same time)
If that is the case, then working the bank holiday should mean that you get your rota'd day off on a different day PLUS a day in lieu for the bank holiday leave day that you worked.
The best way to check it, though, is to add up your leave allowance, plus the days you are allowed for the bank holidays, and make sure it comes to 28 days (plus of course your normal rota'd days off).
However, if the company gives a contractual holiday allowance over and above the statutory allowance, then they have far more leeway as to how they implement this.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Thank you
I get 30 days leave plus bank hols so I've a feeling i won't get the lieu day too. I shall ask HR though to be on the safe side0 -
TBH - you'd be far better off asking your HR or wages dep't to clarify the payment due.
When I used to work 5 out of 7 on call and a work day fell on a bank holiday, I'd get an extra days pay [effectively double time] and a lieu day to bank.0
