If you were married and lived with your husband.... but the name on the Deeds and the Mortgage were in his sole name....
.. and you filed for Bankruptcy.... the house would be safe.
Right or Wrong?

I'm no expert either Jock, but there's lot's of what's when's and why's there.
Did the husband own the house before the marriage and for how long? Who was paying the mortgage and contributing to the household expenses? Why was the husband's name only on the mortgage and deeds?
Lots of questions that need answering to be certain of a desired outcome.

Right.
Husband owned house before we met. ALL bills... mortgage... council tax... TV.. water.. gas.. electricity... ALL from his account only. Statements to prove this.
Husbands name only on Deeds and Mortgage... because it's only his house...
.... BUT.. wife is on remortgage deeds/papers... would that make a difference?!0 -

I have had legal advice on a similar situation... My house for a few years before we met we lived at the property for about a year. Currently its rented out. The solicitor said that house SHOULD be fine but the trustees could raise the question of beneficial interest. I would say you need to show that your husband was paying the mortgage and bills from his earnings.
But you say wifes name is on the remortgage?"Anyone can be great with money. With money, greatness is not a talent but an obligation. The trick is to be great without money" Husband BR Friday 13th June 07 .. still not finalised..
