surrender car on finance

hey guys..

bought a car in 2008 and paid over the half mark and in 2011 i VT the car, they said they would send a pack for me to fill in, never came... ordered another, never came... they sent an agent round my house without a phone call to me to make sure i was in, so he left his number and i rang him 5 times over the course of a week, no answer, left voice mails no returned calls... so a few month later there saying they sent a letter of default which again i didnt get, and by them doing this there saying it cancelled my agreement to VT the car, the woman admit theres been mistakes on both sides, i was passed pillar to post and given wrong information on a fairt few counts and now im in this situation...
they rang me just before xmas, over 1.5years after i sent the VT letter asking me to sort it out, i asked what i was needed to do and the lady said a manager would phone me jan 3rd but never happened.. i told them i couldnt afford to ring 0845 numbers to sort this out, in hynsight i should of sent letters..

now there telling me my only option is to surrender the car and pay the short fall..

does anyone know if theres any loop holes to this cause i simply cant afford the short fall :(

    if you have proof go down the complaints route
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Did you stop paying for the car back in 2011 but are still using it?

    i stopped paying for it 2011 when i sent my VT in and stopped using the car, its been parked up for almost 2 years now

  • yup, didnt know this at the time, i thought was i sent the VT in it was there problem, so they had to collect the car, but was told yesterday that in the consumer credit act i am responsible to make sure the car goes back in a reasonable time
