Emergency tax for almost 9 months

in Cutting tax
Hi,
As the title says, I started my current job on July 30th, 2012 (my first job where I have had a high enough salary to pay tax, and my also my first job that tax year), and for every paycheque so far I have been on the 810L M1 tax code.
I had assumed this was ok because it's similar to the 810L tax code I think I should be on, but I was talking to my dad about it yesterday and he said I have paid too much tax because the emergency tax code won't have given me any personal allowance.
Is he right? And if so, is there any way I can get refunded if HMRC doesn't seem to be listening to my company's HR department? They called up about sorting my tax code months ago, but it didn't fix anything.
Thanks in advance for your help.

No he is not corrrect! 810L M1 uses the correct allowances for 2012/13 on an emergency basis. Each month you would have received the correct personal allowances for THAT MONTH. The problem may be that you may not have utilised your personal allowances for the months of April, May and June.
If you had NO income during those three months, I would estimate that you could be due a refund of approximately £405, assuming that you paid this amount of tax since you started your current job.
Wait until you receive your form P60 and write to HMRC detailing your employment situation for the whole tax year and ask for a review of your tax liability.
In the current tax year your employer should know to amend your code number to 944L, without the M1.0 -
He's wrong - you will have had the personal allowance
He's right in that you won't have had the full personal allowance because of the M1 restriction so you will have paid too much tax
You can get it back by writing to HMRC when you get your P60
Is the code right this tax year?0 -
Thanks for your replies.
Nomunnofun, I didn't have any income in April, May or June (or most of July); I was being supported by my dad and my student loan.
To make things a bit more complicated, I was actually given two P60s - when I started my first few payslips came through my company's parent company, and they were moved to my actual company in January, so I have a P60 for each company. The PAYE numbers are similar but not quite the same. I wonder if this may have made things difficult for the HMRC?
I haven't had this month's paycheque yet, so it's possible I am on the correct tax code now, but I'll contact HMRC once I've been paid for this month to see if I can get any tax back that I've overpaid. Will I need to include my P60s if I write to them, or do they accept copies?0 -
What is the date on the two P60s, you should only ever get one P60 from the employer you are working for at the end of the tax year.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Only an original P60 is acceptable. In my day these used to be stamped immediately and returned - not sure if that is still the case0

Thanks for the info about the P60s. They both say they're for the tax year to 5 April 2013, but the employer name and address is different on each one - one the parent company, one my actual company.0

You would need to post the pay and tax figures from each P60 for information on any possible tax refund.
More importantly though given your original post suggested you had only had one job in the tax year to April 2013, you maybe should sort out what exactly is going on with these companies. P60's get issued to people who are employed by a company so why on earth have you got two - sounds dodgy somewhere along the line.
I would also suggest ignoring any further tax advice from your dad!0
