Neither.
You claim it off the bank.
On a personal note, I keep getting letters from the Council, encouraging me to pay my Rent and CT by DD.
The experience of the OP, is yet more reason why I won't be doing.0 -

He said council did nothing but keep appolgising over and over to him on the phone and assure him that no more would be taken (but seeing as they said this before we will see) but the main woman is on holiday so he's got to wait till she gets back and have a word with her.
Rossendales said that no more would be taken out and would be stopped and the account removed. But as for getting your money back well tough as the person had the same name as you.
thanks for all your help as I know we dont have much hope of getting the money back but we will try, just the thought that he's not paying the money for someones else rent is a big weight off our mind. We can get back to paying for new our kitchen now
Get something in writing off of the council to say that it wasn't his debt, then send a copy of it to Rossendales and demand recompense for the mistake.
You can claim it back off the bank in the meantime (unauthorised charges are immediately refundable), but the bank will just take the money back again if they conclude it was an authorised transaction, so something in writing will assist greatly. What will your verse be?
