DMP with CCCS, CCJ advice?

Hi Guys,

Well after a year of messing around my wife and I got with the CCCS (Stepchange now) and combined our debt (about 18k) into a debt management plan with a manageable monthly payment going to Stepchange and we are finally out of the stress. What we owe is being paid and in 5 years we will be debt free!

I do want a bit of advice from the fine people of MSE though, one or two or my creditors are being pains, faffing with the offer of repayment, refusing to stop interest etc etc. I was fully aware this could be an issue but at least money is landing with them.

If one of my creditors does decide to go the county court route what would then happen? Would I have to then make payments seperate to my DMP to the court to stop a bailiff? Would the court see I was on a DMP and then accept that as my payment?

I have read that generally the court will see I am trying to pay my debt through Stepchange and then accept whatever Stepchange are offering to clear the debt, hence no bailiffs.

    Courts won't make you pay more than you can afford, and you can afford the Stepchange plan, the creditors are wasting their time threatening you with this.

    There is a 'please stop adding interest' template on here somewhere, I am rubbish at adding links, but the smart people here will help you.

    You could try sending the letter, it quotes the Lending Code and dealing with people with difficulties. As you will be debt free in only 5 years you must be making reasonable payments, some forum members plans last 10 years plus.

    Some creditors can be awful, Lloyds cancelled my plan one day, added £135 charges then reinstated it, due to technicalities!!!!!

    I was suprised to read that some people have plans running over 6 years, I was of the idea that if it was longer than 6 they pushed for BR but I guess that is not true!

    Payments on a CCJ are made to the creditor in the normal way. They do not go through the courts.

    Bankruptcy is usually the last choice solution for both the debtor or the lender. The debtor could lose any equity that they have accrued in their property, etc and the lender might only get a fraction of what they are owed.

    One of the loans on my DMP was 7 years to pay off at the normal rate, and (3 years later) is expected to take another 6 years at the current rate. This will decrease as other debts are paid off and I can increase the payments.

    Thanks for your replies guys, long slog out of it, I am lucky that with my daughter due any day I can look at it that by the time she is in year 1 of primary school we will be debt free.

    Makes me smile that.
