HI I HAVE JUST RECIEVED A LETTER FROM A DEBT RECOVERY AGENGY SAYING THAT SHERRIF OFFICERS ARE COMING TO EVECT ME ON THE 1 ST OF JUNE BECAUSE WE HAVE FELL BEHIND WITH PAYMENTS ON OUR LOAN IS THERE ANYTHING I CAN DO TO STOP THIS THEY WANT 1500 FROM ME OR ELSE I DONT HAVE TIS KIND OF MONEY WHAT DO I DO:confused:

    Phone the Citizen's Advice Bureau - they'll know about these things, or at least be able to refer you to a solicitor.

    I presume this is a secured loan on the property? How much in arrears are you and what other correspondence have you received from them?

    Hi, Can you sharea few more details about the loan? Is it secured or unsecured?

    Also a Debt Collector has no legal authority to evict you from the premises if you own the property. The also do not have the right to entry unless it has already been gone to court and the Jude has made his judgement. In this case you would have recieved a letter from the County Court.

    This could be typical scare tactics but we need more info.

    Sorry just to add only appointed County Court sherriffs have the right to evict you.

    They can call themselves what they like but you need proper advice.

    Just done a quick google on extract decree - I take it you're in Scotland?

    By the sounds of it this can only have been issued by a court - were you informed of a court date? Did you go to court? What exactly has the court ordered? I would have thought that you would have been expected to provide a statement of income & outgoings, but this isn't something I know much about!

    The Extract Decree Is For Possesion No We Did Not Know Anthing About Going To Court

    Hmm, if you weren't informed of a court date then this sounds extremely dodgy to me! I would suggest requesting a copy of the extract decree to be forwarded to you immediately, or maybe ask which court issued it? Speaking to the CAB should be high on the list of priorities I reckon, as I think you may need proper legal advice.

    My gut instinct is that if you've heard nothing about court dates then this is bullying tactics, but you need to check it out asap.
