Ex partner died, joint loan

Hi,

My ex-partner recently died and he took out a 2nd mortgage loan on his house to clear his debts but I signed too- the loan people said I needed to sign because I lived there but the house was not in both our names- his house. He said it would not affect me, they just needed to know who was living there. we split up nearly five years ago. I don't know where I stand with this, he had not been paying it and I'm afraid I may be in a serious amount of debt.

I need some advice about this.

    If it was his sole property, it sounds like you signed a consent to mortgage form. This gives you no responsibility for the repayment of the mortgage and the property may well be sold to clear the liability if the estate does not have other funds sufficient to meet it.

    Either way, it isn't your problem.

  • Thank you for your reply, hopefully that is what I signed. I'm not sure because it was a long time ago. I have been in contact with his mother and she says there are a lot of horrible letters with my name on them too. Hopefully I will understand more in the next few days.
