Sorry have you been paying all the mortgage, and what was the deal when you went BR? If it was that you kept the house how can your X now force the sale of it

Sorry to hear this. Hope someone has PM'ed you. I don't know enough to give advice. I gave up a jointly mortgaged property at br coz I couldn't trust my ex to not pull a stunt like this. If you had legal paperwork for this agreement see a solicitor.2019 MFW No. 74 £13700/£30000 (45.66%)
12k in 2018 No. 98 £6274.19/£18000 (34.85%)
BTL (start) £97440.00 (current) £68000.00
Residential (start) £275000.00 (current) £268000.000 -
O.k so you both went brankrupt? Your ex agreed you could stay in the house and he would pay 50% of the mortgage? If my understanding of what you are saying is correct then it's a private agreement bewtween you?
I can understand him not wanting to pay 50% of the mortgage anymore but I can't understand him wanting to force a sale if there is no equity? What on earth would be the point of this?
Is the mortgage up to date? I presume you have been paying your share but has he been keeping up with his agreement? Assuming the mortgage is joint then the bank/building society will not care what private agreement was made between you and will require the mortgage to be paid by one or the other (or both) and will go after whoever is easiest to trace. This is obviously likely to be you as you are living in the property.
I would a) find out the status of the mortgage and whether he has indeed been paying and then wait.
b) wait and see if he does actually take you to court or whether it is hot air. As I said I genuinely can't see what the point of forcing a sale on a house in negative equity is.
c) I'm assuming you can't afford to remortgage in your name?
Best of Luck
