If a Visiting Officer came to the premises (or your accountants) and went through the books with you - that is whats called an Officers Assessment.

Before the Assessment was issued they should have written to you and given you 21 days to contest any amount of VAT that they think is due.

If you did not reply then the Assessment would have been issued to you showing the Officers name and how much is due.

This Assessment becomes due & payable 28 days after it is issued and will accrue interest @ 3% until it is paid - interest is also calculated and notified to you monthly.

Is this what has happened ???

This has not happened, I was asked to contest buy chose not to due to the amount it costs for my accountant to reply, interest is certainly added on to the original but I'm not notified of this, I think it's all automated, either way I cannot afford to pay the amount in full. I get the feeling hmrc isn't too bothered either way, all there interested us following the book and if the distriant action yield nothing they will make me bankrupt?

    OK,

Then write/ring HMRC to ask if they will consider a repayment arrangement.

They can be quite reasonable about arrangements, providing you dont have any outstanding returns.

Be aware that if an arrangement is agreed interest will still be charged.

HMRC want the money, not the aggravation of taking enforcement action !.

  • Hi I already did, they rejected my offer and threaten to distriant. Which is why I asked the question. I thought they want the money also but they are being unreasonable at the moment.

    OK,

If BPSS have rejected your request its not the end of the road and certainly not the start of the distraint process.

Did they tell you why they rejected your request ?

Was it because the proposed timescale was to long ?

Have you received a computer generated note (IDMS99) yet ?

You can write to HMRC at :

    7th Floor
    James Street
    Liverpool
    L75 1AA

and submit your repayment request to HMRC there.

Let me know how you get on please.

You wont receive any code numbers you will receive a demand for payment.

You have nothing to lose by writing to the address I have give as I have been told the people who work there are more pragmatic than BPSL.
