Using holiday in lieu of notice?

I'm due to return to work 21st June at the end of my maternity leave, however I'm not planning on returning. We are applying for a mortgage though and completion will take place during my notice period which could affect our mortgage. Is it possible that I could wait until we have achieved completion and not give full notice, but instead use some of my accrued holidays as part of my notice?

I don't want to leave on bad terms as I get on really well with everyone at work and have been there almost ten years. However, I don't want to lose out on our mortgage either. We're in a tough situation and I hope somebody can help out please?

    Check the terms and conditions of your mortgage with your broker, you probably have to inform the lender of a change in circumstances at any time prior to completion. Also check the maternity leave rules with your employer, you may find you have to return to work for a certain period to be able to keep the benefits you have had.

    I'm pretty sure we'd have to inform them if there were any changes prior to completion. That's why I'm wondering if I can wait until we've achieved completion to give my notice (so technically there would have been no change during the completion period). It would be less than the one month required though but I have 30 days accrued holiday during my maternity leave. I only received statutory maternity pay so I know I won't have to return to work or pay anything back.

    it is good practice(for the business) to have you use the holiday imediately before or after the maternity period.

    you could put that to them.

    Then resign during the holiday period after completion.


    if the mortgage offer is dependant on your salary then you have to consider if you can afford it anyway.

    Thanks getmore4less. I had already advised them how I would use my holiday upon return but I guess I could get on to them now and see if I can change that. That seems to be a good way of getting around all of this.

    We can afford it. Before we paid the fee to the mortgage firm, they said my husband could use his overtime and bonus figures. After we paid the fee, they quickly changed their mind. These figures are not contractually guaranteed but he will definitely get them and they are significantly higher than my wages (just above my wages on a bad year). So yes, maybe we're being dishonest but if they were honest with us from the beginning we would have gone elsewhere and not had this problem at all
