My school needs to make two support staff redundant before September. They've whittled those at risk down to the last 11 and I'm convinced that I'm going to be axed.

A couple of years ago I went to the higher-ups to ask for a pay rise based on the fact that I was doing about 85% of a job that was two grades higher than what I'm currently getting (it worked out at roughly an extra £5k pa). My union agreed that I should be on the higher grade and that if they refused I should just do what was on my existing job description and not a thing more.

Of course they turned down my requested because there was "no flexibility in the staffing structure" (they never said they disagreed with my request based on what I do) but I decided not to make a fuss about it as I didn't want to put undue pressure on myself and carried on working as normal. If, however, they do give me the boot then I'll be working to my exact job spec and no more (which really doesn't involve me doing much).

Annoyingly I suspect one of the people who will be keeping his job is getting paid for things he is not doing.

For some reason though I'd have to work until the end of August to get redundancy pay. Would I be able to make a claim that they've knowingly underpaid me for four years and maybe get some compensation for it?

    Consultation is there to make a case of why you need to stay.

    This could involve justifying your job over others by pointing out what you do and they don't.

    working to contract is risky as there will almost certainly be general stuff about doing things as asked or to meet busines needs etc.

    A better approach is to usualy do rapid handover to others ASAP.

    You are eligible for redundancy pay after 2 years of employment.

    Why do you think you would have to work till August.

    I would think you have just as much chance of keeping your job as the rest of them to be honest.

    It is at the stage where we've got to fill in a "selection criteria pro-forma" on which we list our skills. Problem is they seem to have worked out a future staffing structure already which leads me to believe they've already decided who is going.

    AIUI Schools budget/work/pay on the school year.

    the new structure will probably kick of then



    you need to match your skill to the new structure

  • Well you've been paid the amount you have been contractually obliged to be paid. Unless you had a contract that said you should be paid more and have been paid less getting a lower rate than you think you deserve is not grounds for a claim (otherwise every man and his dog would be putting one in!).
    Thinking critically since 1996....

    It's not for what I think I deserve - it's for work I've actually done that's the basis of a job specification two grades higher than mine! Denied because of the "staffing structure" indeed.

    I don't think you would get anywhere with it to be honest. You should have dealt with it at the time. You could have done and actually decided not to.

    make a request for more money does not mark your card.

    Consult make your case why they should keep you.

    if there is a new set of jobs make sure you fit one of those.

    if none of the jobs include the things you do then ask why? don't they want them doing any more or have they just forgotton thye get done.

    Knackered is the other person doing the job that you do 85% of the opposite sex to you? If so I'd consider making a claim for equal pay.
