Hi All,
Can anybody clarify my position. My partner has a 2nd charge registered against my property.
Can she force me to sell my property to liquidate her 2nd charge or would she have to wait until i agreed to sell it?
Any advice a great help

When you say it's "my property" do you really mean that the property is jointly owned by both of you, but only occupied by you, or what exactly?0

I have a property on which a partner has a 2nd charge.
Is she entitled to "force me to sell" in order to claim her 2nd charge against it or does she have to wait until, i, as 1st charge holder, decide to sell.
Any tips, help or advice welcome.

How can you have a "1st charge" on your own property?
You need to be more specific about who the owners of this property are and who owes what to whom.0 -

I assume you do not have a mortgage as the mortgage company/bank would be the 1st charge holder0 -
If she has registered a charge against your property it would be up to a court to decide whether to enforce it or not.
As you have not told us the reason for the second charge we cannot advice further.0 -
A second charge can exist for many reasons. Usually it's to ensure you repay debt when you sell. Rarely would it give someone a chance to force a sale.
What type of second charge is it?
Why was it obtained?0
