Tmobile/Buchanan clark + wells

Hi, I was declared Bankrupt in Aug 06 and discharged end of MArch 07. The OR let me keep my contract with Tmobile. From Jan 07 my bill went up, basically from where I got ripped off from Dialaphone on a half price line rental plan. The contract ends this month but where I havent been able to pay it, it has gone to Buchanan + Wells. I phoned them today and offered a payment plan, £20 a month. The twerp on the phone said they couldnt accept it, I have to pay the full balance. In the letter it said I could arrange a mandate which I told him and he said it shouldnt have been worded like that!!!
Anyway, as it went up during my bankruptcy can I forward my bankruptcy details to them to clear the debt or do they have to accept my offer. He was saying about sending Bailiffs etc. which I am not worried about, scare tatics!!

Sorry I hope this is understandable, I just got off the phone with him and he really annoyed me!

Any help appreciated.

    I 'think' that its an after Bankruotcy debt, so its yours im afraid. But hey ho... how can they make your credit file worse than having a bankruptcy on it !! Id just send them the payment you want to send and that will reduce the balance... regardless as to what they say.

    They are not nice there, they have my british gas account and still threaten to 'take it further' even though I tell them the debt was included in the bankruptcy.

    Dont let them get to you... Your in control !
  • Thank you, Il just send in my payments every month and that will have to be it. There isnt really much else they can do. Im not going to pay any extra charges they stick on now as I have tried to make an arrangement with them, do you think this is right?

    The OR allowed you to keep your contract, but the debt at issue was accrued after your BR, so I don't think it can be covered by your BR. You'll therefore have to make some kind of arrangement to pay with them. They don't have to accept your offer, certainly not without at least seeing a statement showing your income & outgoings, proving you can't afford more than you're offering.

    If I were you I'd make your offer in writing instead of by phone, enclosing a copy of their letter to you & saying that you want to pay by the mandate offered in the letter. I suggest you keep all your dealings with this company in writing from now on - could you possibly go onto a PAYG phone, or cut back on other things in order to pay this debt off asap?

    Your chances of getting credit are affected anyway by the 6-year post-BR term, but don't forget that this company could put the debt on your credit file at any point. That will be there for 6 years from the date it goes on your record, so it's really in your interests to get this sorted out without aggravating them enough that they do that. An entry on your credit file will look as though you went BR & were subsequently discharged, then managed to get into debt again. Depending on how much is owing, they may well go down the bailiff route, so I wouldn't ignore that if I were you. If the debt is large enough & if it takes ages to come to come to an agreement with them, it might not go on your file for a year, meaning your credit file will be affected for 7 years after going BR. Even though you don't like doing it, I'd get it sorted out as quickly as possible, as you want to keep the effect on your credit file to as close to 6 years as possible, so that you have a completely clean file at that time.

    I, too, have had several 'run-ins' with BCW, and, as stated above, they are 'not nice people'.
    However, even these people are not above the law - much as they would like to think otherwise.
    I suggest that you pay the £20, as offered. SHOULD they decide to take you to court, then the judge would see that you have been serious about this debt, and, in my opinion, the court would be very unlikely to force you to pay the whole amount. They may even reduce your payments, if you are struggling with £20 a month.
    BCW would have to accept any decision by the courts.
