HELP Notice Of Seizure And Inventory Of Goods

I recieved a call that a baliff had called and spoke to my wife today, He has left a FORM 7 Notice Of Seizure And Inventory Of Goods, With the car that was parked outside on it. which belongs to my mum which my wife uses to get to and from work a couple of times a week, My mum only has a V5 and insurance details, No reciept as she brought it a few years ago and doesnt have any other proof she owns the car?? The bailiff keep repeating saying a V5 doesnt prove ownership as it does state on the top? as the car isnt worth much and doesnt belong to me how else can i prove this, Any help or advice would be much appreciated as he is coming back tomorrow?

    Hopefully someone who knows what they're talking about will be along soon but in the meantime, might it be a good idea to move the car a few blocks away?
  • i dont think they can take the car unless its secured against the debt, i.e hire purchase. maybe some one with experience of this will be able to assist as im really not sure

    No, if there was a CCJ and the Bailiff had correctly levied against the car and the car belonged to the person responsilbe for the debt then they might well be able to seize it.

    However, if the car doesn't belong to the debtor (which it doesn't) then they can't.

    By the way, there are a lot of debt collection companies that try to claim that they are "bailiffs" when they're not, do you have a CCJ (or council tax debt)?

    As far as the car goes, you should probably create a statutory declaration like below. Send a copy recorded delivery to the bailiff (and keep a copy to hand to them). Also send a copy to the creditor who owned the original debt.

    I believe you should get this witnessed at a solicitors (cost £5/10)
    STATUTORY DECLARATION
    I, [name] of [address]

    make the following declaration under the Statutory Declarations Act 1835

    The <type of vehicle> vehicle, registration <reg>is
    owned by Ms XXXXXXX.

    I make this statement conscientiously believing the same to be true and by virtue of the provisions of the Statutory Declaration Act 1835.

    what debt is the bailiff enforcing ?
    what bailiff firm is it ?

    If they come back and try to take the car, call the Police immediately and report a theft in progress - they cannot take a car that does not belong to you. Scum as usual appointed by the Council but it is a reminder that Council Tax is one of the most important things to try and pay - not easy though I know

    send a copy of the v5 to the council(include a copy of the notice of seizure to the council) and Ross & Roberts by recorded delivery letter
    tell them you have now provide proof that the vehicle that has been levied against your debt does not belong to you ask them to remove the vehicle from the levy and all associated fees
