Ok, first thing first.
Was the final warning last year your only warning, including any verbals?
Do you have evidence that other members of staff use the internet?
Have they carried out an investigation prior to the disciplinary?
If you are ill, then you are ill. Will your doctor sign you off with WORK related stress?
It doesn't matter if this date takes you past the 25th, you were made aware of and did the deed before this date.
You need to show that they are out to get you, not just feel it.
It may help if you write everything down, start from the beginning. You will be surprised what it looks like on paper rather than in your head

Although your company has no 'IT Policy' - what does it state in the staff handbook / employment contract?
I'd be surprised if a company hadn't got something in place in regards to IT use.
Secondly - did you use the Internet for personal use within your working hours? For example - if you work 9-1 lunch for an hour then back 2-5, if you used the Internet between 1 and 2, you could possibly claim that everybody uses the Internet for personal use on the breaks and you didn't know it was acceptable, but do now so won't do it again.
You can be dismissed regardless of if your off sick I believe, although I'm not that clued up on employment law, so I'm sure someone will be along shortly to confirm
If you want to keep your job long term, I would suggest NOT trying to escape the inevitable by pulling a sick note out. It would P off most employers. On the other side, I'm not entirely sure where you stand in regards to your previous warning, so again, someone who's more clued up will reply soon.
How many staff are employed in your office? Do managers openly go on the Internet in work time? Why did you think it was ok to do this at work? What policies an procedures are you aware of? Is your work up to standard? Do you want the job?

Basic gist is the OP is on a final warning and now believes the company are looking to dismiss him for going on a gambling site at work.
Asked whether he should go ill and whether if he returned after the final warning lapsed would that help him.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
