Can i declare bancruptcy for someone else?

Hello,
Can i file bankruptcy for my mother if she was taken to prison?
She had current account and credit card with lloyds. Together she owe about £5000 and its increasing due to fees, penalties etc.

Since she has been taken to prison she lost her job and there is no income to pay back. She has been sentenced for 4 1/2 years so i can imagine over this time debt will only increase.

I will appreciate any advise. Thank you.

better to leave the debt alone?

Eventually, the bank may petition BR, to realise any assets your Mother may hold [property, for example?}...but they will have to pay for the privilege.

But, whilst she is in Prison, there is little the bank can realistically do.

Well with a debt at that level a DRO might be better depending on what assets she has. Also she could consider a payment plan once she comes out.
I would assume that perhap if you had some legal authority to run her accounts (power or attorny) or something then perhaps you could make her bankrupt but you would need to prove it was in her best interests.
I'm afraid I don't know much about being in prison but is she able to write to all her creditors and let them know she is in prison? I mean realistically what are her creditors going to do? threaten her with prison?

It is possible to go bankrupt from inside prison, I've had a few cases that I dealt with like that. Not sure how, is there some kind of support worker that can be asked?
  • She's best to see CAB in prison ... They can sort this n help her do letters and if needed process a BR... But u don't need to do this ...
