Holiday,sickness issue

Hi if an employer is off on long term sickness,not getting paid,are they entiltled to ie any holiday owd/issued or paternity rights,without taking the you know what.

If you are off work with illness, and that of course prevents you from taking your holidays, then you are not entitled to payment for those holidays.
You can and should have them carried forward to the following years entitlement. But I am unsure if there is an allowance on the quantity so that will need a good looking into.
I am not sure what you mean regarding paternity rights though?

The holiday I sort of know about,my employer did allow me a week last year and carried the rest over into 2013,I didn't know if I could request holiday or if I had paternity rights ? I read that if your in holiday and you get sick your holiday gets reimbursed.0

You are not making things very clear.
You can request a holiday anytime, but it needs to be agreed with your employer. What paternity rights are you wanting?
Yes, if you are on holiday and become ill, you should default to sick procedures and any remaining holiday put back in the pot - so to speak.
Example:
If you book a week off, then fall ill on Tuesday, your sickness procedure kicks in on the Tuesday. So you have taken one day holiday, the other 4 return to the annual entitlement.
If on the otherhand, you take the last week of your holiday year entitlement (last week in March for example) then you cannot take your remaining holidays in that year so they should be rolled forward.

Ok,i see,so if wanted to have a weeks holiday for example,i just submit this in writing as to speak and wait for the out come.
I just didnt know if 'paternity' was different to holiday leave,ie not affect holiday days etc and was it possible to have this service whilst on long term sick.
If you dont mind me asking is it ok for me to have a holiday whilst on sick leave,seems a bit cheeky,but i have around two weeks form 2012 and whatever this year,i just want to know best way around this.0 -
You can request to take a holiday whenever you like. Ill people still have holidays. However, you have to be careful on what you do.
Why are you on sick leave?
How long have you been ill?
Are you getting full pay or SSP?
Why do you want a holiday? Is it because you feel you have to use them or you are going on holiday anyway? Is it to bring in extra income if you are only getting SSP?
As for paternity rights, you have rights to it, but not to be paid for it.
There is a web of reasons and why's, the more details you give, the better the advice will be

You can take and be paid for holidays while off sick.
(some do if they don't get sick pay)
you should ask for permission to go on holiday(even a family visit) while sick even if not taking the holiday paid..0
