Lloyds TSB again

Hi

Just received another letter from TSB saying we are behind with agreed payments etc.

We are on DMP with CCCS for the last 6 months and each month we have this with TSB threatening defaults, courts extra charges etc. Each month we ring them up to let them know we are with CCCS and they say that they haven't received the payment plan from CCCS, they then say that we have £225 each month left over and they want the whole lot, we then tell then that it has to be shared between all creditors not just them and they deny all knowledge of receiving paperwork and we have to resend it (although they say we cant it has to be CCCS) when I ask them how they know how much money we have left if they have not had paperwork they say I am being difficult and rude and they will no longer deal with me, this morining I had to ask 17 times to be put through to the manager before they would, the manager just repeated the same old story to me and said to get CCCS to send paperwork, spoke to CCCS who said that they have sent the paperwork several times at my request and the lady pointed out (nicely) that they were a charity and sending the same stuff every month could not go on.

I don't know where to turn to now and I just cant take much more of this. Why do TSB have to bully you so much, I know we took the debt and are trying as hard as possible to find money but we cant pay them all of the money they want because the other companies will start giving us hassle and I've had as much as I can take I don't know what to do. Can anyone advise me please.

    Hi,

    I can't offer much advice as I am not with a dmp, but have you thought about asking payplan to send the information recorded delivery? You could offer to give a donation of five pounds for this and then Lloyds wont be able to deny that they have not received it? Either that or ask Lloyds to fax payplan for a request?

    They seem absolute idiots and I am sorry you are having no joy with them. I dont know if you have noticed but there is a thread designed for dmp support so if you dont get enough help it may well be worth reposting on there.

    I only contacted LLoyds via letter they always claimed never to get letters so I listed every single letter and payment I had sent them and lodged an official complaint through there complaints procedure. They backed down then and also refunded some of the charges and interest.

    Can you post a copy of the letters yourself via recorded delivery?

    I echo "Rayday2" - they ended up paying me £100 compensation as they "lost" letters (recorded delivery) and cheques! In their reply to my complaint they virtually admitted their collections centre in Brighton is a glorified post-room dealing with thousands of items.

    Hi, I had exactly the same problem with the Halifax.

    They claimed not to have recieved any of my letters over a 4 month period and eventaully I had to make a complaint. After this still didnt sort out my problems I wrote to them threating too report them to the Financial Ombudsman and Trading standards.

    After I sent the letter I received a reply within about 5 days and they agreed to the terms that that the CCCS had set out (£1 token payments) and froze all interest. they also refunded the interest they had charged as a gesture of good will what amounted to around £500. I have had no problems since.

    another trick I have picked up on here is to attach a payment by cheque to the letter you send them for £1 or whatever you can afford. Mention this in the correspondence as all you can afford to pay.

    If they cash the cheque they have no way of saying that they have not received the paperwork as it was clearly attached to the letter.

    I dont know if its any help but this was a copy of the actual letter I sent them in my case. Sorry if it bores anyone. It would seem the threat of contacting the regulators kicked them into action. Obviously this is not a template but you get general outline.

    Dear Sir/Madam,


    I write with regards to the outstanding balance on the above mentioned account.

    I originally wrote to you on the 29th September 2006 regarding the difficulty I had found myself in repaying this sum and returned my Credit card/Debit card and Cheque book as requested.

    Included with these letters was a breakdown of my living expenses and list of creditors that was put together by me with the help of the CCCS. (My CCCS client reference number is ). After speaking to one of your customer service team I was informed that you had received my “plastics” back on the 2nd October 2006 although you claim not to have received the paperwork. The paperwork and the cards were stapled together and were placed within a plastic wallet so I find it hard to see how these got separated.

    I still have not had anything in writing from you with regards to this debt or anything regarding a repayment plan. On each occasion I have telephoned I have been told that you had a backlog of paperwork and that I can either resend the information or wait until it is processed. I have since resent copies twice by post and also by fax.

    I cannot believe that an organisation of your size would take nearly 5 Months to process this information and feel that either the paperwork is deliberately not being placed onto my account or it is the Halifax’s Procedure to ignore letters from your customers.

    After speaking to one of your customer service team again this morning with regards to my problem they have asked me to send the copies of the Living expenses/Creditors I originally sent you.

    Please find these attached.

    I have also noticed that on my statement dated January 07 that you have frozen my interest until March 2007 but again have had no letter explaining this and had to call to find this out. It seems that the interest was frozen after my last telephone call to the complaints department.

    I must say that I feel very disappointed in the way that I have been treated by the Halifax and after speaking to the CCCS this morning have been advised that I should forward my complaint to the Office of fair trading and The Financial Ombudsman Service.

    Over the last 6 months the stress your organisation has put me under with the constant barrage of phone calls and lack of response to my explanations and letters has nearly driven me to a breakdown. I also have had to visit my doctor as I am suffering from depression. I feel that this has seriously affected my health and caused problems with my current employer.

    I am now once again trying to get this matter sorted out and I hope that this letter actually reaches the correct department and can be dealt with.

    If I do not hear anything from you within the next 14 days I will presume that once again my letter has been ignored and I will be looking into taken my complaint further.

    I do hope that this matter can be dealt with and will not involve any further action and I look forward to your reply,
