OP, when you come to an open forum looking for cheap legal advice you should be forearmed in the knowledge that lawyers seldom do anything for free.
You seem to simply be seeking someone to confirm your interpretation of the law. There can be many paths to the right answer so if you are so convinced you're right, either see a lawyer or test it in court.
We'd all be interested in the outcome.Opinion, advice and information are different things. Don't be surprised if you receive all 3 in response.

okay that makes sense..although it would be interesting to know how the accounts came to make their mistake it isn't one i'm looking to investigate, they have admitted fault on that atleast
so i just want to find an easier way forwards.
