Not coping today

I have been worrying about my situation for a while, and although I was advised to wait for my IVA people to make me bankrupt, I have decided to go for it myself instead so that, as far as is possible, I am in control. Now I am panicking about finding the money/digging out all my paperwork/getting up to date balances etc. I have also come down with a dreadful sickness bug, but have come into work regardless as I cannot afford to be off sick (don't get paid) Its horrendous. I need to get this all sorted asap as I'm just not coping atm...

    sorry to hear your not well or coping at the moment

    Right stop paying your IVA and save this money for your bankruptcy fees also any creditors not included in your IVA.
    dont worry about upto date balances as the OR will be able to get those if when you fill your bankruptcy forms in you write estimate next to each creditor then that should be fine .

    you will need the names and account numbers of all your creditors and the addresses for your forms this includes any banks you owe money to in the forms of overdrafts etc .

    you will need to open a basic bank account for all you income to go in and your living expenses to go out off rent utilitys etc ,would also advise you withdraw any cash out of any other bank accounts you hold .

    Try not to stress too much - I think most of us are prone to sickness in the lead-up to going BR, so try not to let it overtake you. :) First things first:
    • Ring any of the free services such as CCCS, Payplan and National Debtline - you may need to make an appointment for an in-depth interview.
    • Ring all your creditors & ask them for a letter confirming the balance outstanding - you don't need to make the call if you've had a recent statement, as that will do. If they try to ask you why you want to know, just tell them you want to get your records in order & need up-to-date figures. There's no point telling them you're thinking of going BR, as they probably won't believe you anyway.
    • Stop all payments to creditors immediately, but don't tell them you won't be paying them. That should enable you to put aside whatever money would have gone to them towards going BR within a month or so. If creditors ring/write, ignore the calls as best as you can, change your answering machine set-up so that they can't leave messages & don't take any calls or reply to any if you don't recognise the caller's number as someone you want to speak to.
    • Get current bank statements.
    • Next the court bit. You can find out which court would be dealing with your hearing here - ring them to find out their procedure, as some can see you on the day but others operate an appointment system. Some courts will send you the bankruptcy forms, but you can download them for yourself from the Insolvency Service - you'll need forms 6.27 & 6.28 (don't forget to download the guidance notes too).
    I think you're doing the right thing in declaring yourself BR rather than letting a creditor do it, for reasons that have already been discussed elsewhere on this forum. :)

    Thanks for your support/advice. I ended up going home yesterday after throwing up in a meeting (very professional!!) but am back in today tho not feeling much better.

    I am going to use the weekend to try to get my paperwork together, and to work out a sensible SOA - the one for my IVA just didn't give me enough for everyday living, and while I had a 'contingency' allowance, that didn't last long when I got stung for a £300 dental bill!

    I am also getting my CV in to some agencies, so that I can be working nearer to home - this is actually the main reason I am having to go BK as at the moment I am travelling for 4hrs a day, and my salary just does not make it worth while. Its possibly another reason why I feel so run down and ill all the time - its one thing after another atm, and Im normally really healthy.

    I will probably be asking lots and lots of questions over the next few weeks....
