Work Problems

Please bare with this thread its going to be long .

Me and my girlfriend joined a catering company at a golf club in june 2012 . I was employed by the catering company who have the franchise at the golf club. I was employed as the club steward and my girlfriend was here for tea/coffee and light snacks.

In September 2012 the company we were working for left and the golf club offered me and my girlfriend the franchise knowing full well we had no major catering experience.

The club captain at the time was brilliant with us offering us his 100% support.

The new Club captain, Lady Captain and Seniors captain all hate us for what reason we just dont know but what I do know is the current club captains friend who owns a pub is desperate to take the franchise on at the golf club ;)

The Captains have been nothing but problems for us saying bad comments about us to other clubs, Posting damaging posts on facebook for all to see.

The other day I reported the club captain for bringing his own food into the clubhouse and eating it which is against clubs rules. The captain asked me for a quiet word regarding this matter but only got in my face and started swearing at me and intimidating me .

The intimidation and bullying has got so bad that were starting to fight back and argue for what we believe is right but the head of the house and bar committee has told us we need to watch our attitudes and if we wont change them we must look for another job.

We have had 90% backing from the full committee but the small minority which unfortunately is all the captains are out to get us and tarnish the reputation of a business we set up to provide the club with match meals etc.

There latest trick was to order food for 25 people , We bought all the food in but only to be told 20 had turned up on the day and that I was out of luck if I thought they should be paying for 25 the quantity they ordered for !!

I feel powerless in the fact that our franchise comes with a flat with all bills paid for and now we've been pushed so far by the three bullies we are now left with nothing.

What does the franchise deed say about notice?

What do your written terms of trade say about acceptance of orders in terms of paying for the quantity ordered?

Franchise says we can be given one months notice in the first 12 months after 12 months we need 3 months notice.

We dont have a written terms of trade but they all no we need definate numbers 24 hours in advance and that is what they pay for.

For example we did a buffet on Friday night for a lovely old member he asked for a buffet for 70 only 63 turned up but he still paid the £8 PP for 70 people

If you have their order in writing, invoice for the full number that were booked for.

Start including terms of your business when accepting such private orders. That would include paying within a specified period of time (either in advance or after production of invoice) or that they pay a deposit (which itself specifies the number to be catered for).
