help with old loan debt
Hi
Hope someone can help. In 1999 I took out a loan for a car (cash price £7900 less £900 deposit) Interest was at 27.45% giving a total payable of £11920.
We subsequently paid every month until I was declared unfit for work and I have never been able to return to work. We have paid to date £7992.67 and the balance outstanding is £3027.33. We have had an agreement to pay £10 per month and was paying this however, the debt has passed to 2 different companies over the past couple of years and the most recent denied that they had agreed this eventhough they had accepted the payments and even sent us a payment card!!! They told us we would need to pay in full. I explained to them that this was not possible and they sent me a means test out to complete, which I duly did and offered them £15 per month. They declined this offer and made numerous threats to take me to court. I have remained in limited correspondance with them and they have requested that I fill in a further measns test. I asked them for an explanation as to the point of this as my situation has not altered since the last time they refused my offer. They have responded to my last letter with the request of another means test. Can anyone advise me as to the best way to deal with this problem.
1. Can they still take me to court?
2. Can I refuse to pay any more money to them with getting into further trouble with this debt?
3. Is there a period of time that once elapsed prevents there from being a legally binding contract with me?
Additional info : The garage owner was sent to prison for fraud with speedometers not long after we purchased the car. We spent £600 on head gasket and then the in board computer went and we were quoted £1500 to repair. We could not have this done and the car remained in my back yard for six months and then I had it towed away we did not receive any money for it as far as I was aware it went to scrap.
Any advice is greatly appreciated. Thanks

1. Yes they can take you to court BUT a court will only make you pay what you can afford to pay not what the debt collection company wants!
2.You will do yourself no favours by not continuing to pay the £10 or £15 you are paying now.
3.IF the original lender or any company that has bought the debt off the original lender has had no correspondence with you for a period of 6 years then it is statute barred. IMO this will not help you in your case.
Your additional info again in my opinion is of no relevance to your case.
Get legal advise from someone like CAB - they will put you right.0 -
