How do I take his name off the mortgage??

My ex-partner is violent and was arrested 3 months ago for assulting me (once again, only this time the police did take it seriously). The case goes to court soon. In the two years he lived with me, he did not pay towards the bills - only offering token amounts on a couple of occasions, but his name is on the deeds of the mortgage. He refuses to sign for the house to be sold, and as the sole bill-payer for over two years, on a part time, low wage salary (I have looked for other work and will be doing night time care work shortly) I am drowning finacially. He is subject to a non-molestation order and cannot EVER come back to the house or contact me, other than through my solicitor. I feel a bit like a sitting duck, as he knows where I am and I cannot move, nor can I afford to keep going like this. Does anyone have any advice as to how I can make this man sign the mortgage over to me - my bank accounts prove he has never contributed financially to the property. Many thanks for your help :(

    Unfortunately, only the lender can release him from the mortgage. However, to do so you would have to prove affordability and from your post this maybe difficult.

    The other possibility - which costs money - is to get a court order for the sale of the property, The fact that there is a non-molestation order in place would probably be enough to justify an order for sale.
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'
  • Thank you both so much - My plan is to get the court case for assault out of the way - then take this up with the mortgage lender. I am hoping that the fact he has not paid a penny in the years he lived here and has not contributed since he was arrested, plus a conviction for assault, will help me rid myself of this leech for once and for all.

    The mortgage lender cannot assist with anything unless your ex agrees to disposal of the property. Only a civil court can give the necessary authority.

    If you have a spare bedroom, you could get a lodger to help your finances until you can sell the house. Look at the rent-a-room scheme.
