letting agents and bankruptcy

I rent through a letting agent as a house share with other friends. We all pay our rent and bills individually and have lived there for three years and have never missed or been late with a payment. I get on well with everyone at the letting agent.

If I go bankrupt will the OR definitely tell the letting agent or is it down to his discretion? Will I have to move out or is it up to them/the landlord?

Really worried about this issue...

  • I asked a similar question myself a while ago and was told that yes the OR will let your agents know.
Though i was also advised to get in there first and contact the agents explaining the situation and that most agents/LL will allow you to keep the place as long as the rent is up to date and the place kept well looked after.
My parente have just agreeded to go as guarentors for me if the worst comes to the worst. Do you have anyone that could do that for you? it may help.
I'm sure someone will come along soon with more/better advice.
    Good luck!

Do you have a copy of your tenancy agreement? If not, get one, and read it thoroughly!

I have the same fear, but my tenancy agreement has no mention of bankruptcy in it, so I'm hoping that will afford me some protection if the landlord gets arsey!

The evidence from peoples experiences, here and elsewhere, is that sometimes they are told and sometimes not.
It seems to be up to the individual OR whether they do this. :(

If my memory serves me right someone once posted on here who works for a letting agent and I think she said that in the ten years she'd been in the job only one landlord had asked somebody to leave because of BR. Hope that helps to put your mind at rest...a little.

I privately rent and had to send my OR a copy of my tenancy agreement. Luckily there is no clause excluding BR's so I'm hoping nothing more will be done.

My OR said she would not be contacting our landlord, as they were not a creditor. I double-checked and she confirmed this.
