Help Please - Being chased for joint debt after husband bankruptcy

apologies first as shift key not working for capitals. my husband is a discharged bankrupt - around 2 years discharged. i have suddenly started receiving letters for a joint debt that was included in the br. it is for 37000 k. there is no way we can pay this, i am currently paying minimal amounts for other small debts in my name, around 70 pound a month in total for 3 debts. am i going to have to go bankrupt myself now - i am really worried as i thought we had finally got ourselves back on our feet after he was redundant for 2 years following bankruptcy. -this site was of great support and use to me four years ago and i am hoping someone can give me advice.

    I'm afraid you are fully liable for the debt that was joint, it now transfers to you solely as his liability has ended for it with the BR. If you have no way of paying it back then BR may be an option for you. I'm surprised that you weren't informed about this by whoevere advised your dh about his BR?

    my main worry is that i have a car on hp. i am the registered keeper and the agreement is in my name. is there any way i can change all this over to my husband's name or someone else so i can keep the car? also - do you know if the income is my husband's income as i don't work - we get tax credits as well. i think what i mean is if he is earning and can afford to pay for the car monthly do they include his income in my bankruptcy and statement of affairs?

    Hi...with the car on HP, it isn't an asset of yours....it belongs to the HP company.

    Whether they will terminate the agreement, or allow you [either of you] to continue to pay will be up to negotiation. Probably they will keep the agreement going.

    Whilst you OH doesn't have to declare his income to the OR....the OR will need to see proof of the percentage contribution to household expenditure.

    If no income information is given for OH, then the OR will assume a 50% contribution.

    Since you don't work, the income [plus tax credits] must be your OH's.
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    This is exactly what has happened to me. My husband was bankrupt 6 years ago and included in it a joint debt. Unfortunately they are still chasing me after all this time.
    I have been ill for a long time and not working so there is no way I can pay it. After advice I have decided to go through bankruptcy. I actually will be relieved to finally get rid of this debt.
